{"id":1163,"date":"2023-12-12T11:21:00","date_gmt":"2023-12-12T11:21:00","guid":{"rendered":"https:\/\/whistle-blower.com\/?post_type=event&#038;p=1163"},"modified":"2026-01-23T12:34:09","modified_gmt":"2026-01-23T17:34:09","slug":"whistleblower-advocates-call-for-best-practice-whistleblower-resolution-at-cosp10","status":"publish","type":"event","link":"https:\/\/whistle-blower.com\/es\/event\/whistleblower-advocates-call-for-best-practice-whistleblower-resolution-at-cosp10\/","title":{"rendered":"Whistleblower Advocates Call for Best Practice Whistleblower Resolution at CoSP10"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On December 12, the second day of the <a href=\"https:\/\/www.unodc.org\/corruption\/en\/cosp\/conference\/session10.html\">10th Conference of the States Parties<\/a> (CoSP 10) for the UN Convention Against Corruption (UNCAC), the National Whistleblower Center (NWC) was given the floor. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following remarks from state delegates, NWC Executive Director Siri Nelson addressed the <a href=\"https:\/\/whistleblowersblog.org\/global-whistleblowers\/cosp10-commences-with-strong-statements-and-resolutions-on-whistleblowing\/\">plenary session<\/a>, championing the rights of whistleblowers as an indispensable tool in the global fight against corruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nelson emphasized that whistleblowers are the &#8220;infantry of the anti-corruption effort&#8221; and must be central to every discussion on the topic. &#8220;Whether it be identifying the real use of assets, to identifying where bribery occurs\u2026 whistleblowers are the key to uncovering the evidence needed for successful prosecutions,&#8221; Nelson stated. She stressed that this is an &#8220;empirically supported fact,&#8221; arguing that whistleblowers outperform every other mechanism for uncovering criminal activity.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The &#8220;ACE&#8221; Model for Whistleblower Protection<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">During her address, Nelson called for a UNCAC resolution that establishes clear best practices for whistleblower programs. The NWC expanded on this proposal in a <a href=\"https:\/\/www.whistleblowers.org\/wp-content\/uploads\/2023\/11\/COSP-Written-Statement-NWC.pdf\">written statement<\/a> for CoSP10, outlining a framework it calls the \u201cACE\u201d model. This model is built on three core pillars:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Anonymity:<\/strong> Providing a guaranteed confidential channel for whistleblowers to report corruption without fear of exposure.<\/li>\n\n\n\n<li><strong>Compensation:<\/strong> Offering monetary rewards to whistleblowers, specifically between <strong>10-30%<\/strong> of the sanctions collected as a result of their successful claims.<\/li>\n\n\n\n<li><strong>Enforcement:<\/strong> Ensuring that whistleblower claims lead to swift and effective sanctions against guilty parties, supported by robust collaboration between domestic and international agencies.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The NWC points to the United States&#8217; <strong>Dodd-Frank Act<\/strong>, which created the SEC Whistleblower Program, as a successful implementation of these principles. This model has also been praised as a set of best practices by the Organisation for Economic Co-operation and Development (OECD). The effectiveness of this approach is evident in its results; the promise of anonymity and significant financial rewards has motivated over <strong>6,000 tips<\/strong> from individuals outside the U.S. to the Dodd-Frank program alone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;It was an incredible honor and opportunity to speak before the plenary session of CoSP10,&#8221; Nelson later commented. &#8220;I hope that delegates will take note of our outlined best practices and adopt a whistleblower resolution of real substance.&#8221;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Status of Whistleblower Resolutions Remains Uncertain<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Behind the scenes on December 12, closed-door negotiations on various <a href=\"https:\/\/whistleblowersblog.org\/global-whistleblowers\/cosp10-commences-with-strong-statements-and-resolutions-on-whistleblowing\/\">draft resolutions<\/a> were underway. Two of these drafts, focused specifically on whistleblower protections, were introduced by Serbia and Palestine. By the day&#8217;s end, the delegates from both countries had agreed to merge their two proposals into a single resolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final text of this consolidated draft has not yet been made public. A key point of uncertainty is whether it will include language on whistleblower awards.
