Section 748 of that law added a new&nbsp;<a href=\"http:\/\/www.cftc.gov\/ucm\/groups\/public\/@whistleblowernotices\/documents\/file\/sec23commexact.pdf\">Section 23 \u2014 \u201cCommodity Whistleblower Incentives and Protection\u201d<\/a>&nbsp;\u2014 to the Commodity Exchange Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the program issued its first award in 2014, the CFTC has granted&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/sites\/whistleblower\/files\/2026-02\/FY%202025%20Whistleblower%20%26%20Customer%20Education%20Report.pdf\">55 award orders totaling more than $390 million<\/a>&nbsp;to whistleblowers. These awards are not reserved for U.S. nationals \u2014 the CFTC has&nbsp;<a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/8239-20\">publicly confirmed paying whistleblowers based outside the United States<\/a>, consistent with a program built to reward original information from anywhere in the world.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those awards are tied to enforcement actions that have collected&nbsp;<strong>over $3.2 billion<\/strong>&nbsp;in monetary sanctions. Every dollar of every award is paid from the&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/overview\">CFTC Customer Protection Fund<\/a>, which is financed entirely by the sanctions that violators pay \u2014 never from the pockets of harmed customers, and never from taxpayers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC program is global by design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In FY2025 alone the agency received&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/sites\/whistleblower\/files\/2026-02\/FY%202025%20Whistleblower%20%26%20Customer%20Education%20Report.pdf\">1,697 tips<\/a>, and the Whistleblower Office reports that submissions came from many different countries \u2014 with the most originating from the United States, Canada, and the United Kingdom. You do not need to be a U.S. citizen, live in the United States, or work at the company you\u2019re reporting to take part.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Continue reading to learn how international whistleblowers can report commodities and derivatives fraud to the CFTC, and what to expect before, during, and after filing.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Before You Begin: CFTC Whistleblower Self-Assessment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before taking any further steps, keep the information that you have to yourself until you\u2019ve retained counsel. The CFTC weighs a number of other factors, discussed below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Types of Violations to Report<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC\u2019s jurisdiction covers the full range of Commodity Exchange Act violations across the U.S. derivatives markets \u2014 futures, options, and swaps \u2014 as well as fraud or manipulation in the sale of any commodity in interstate commerce, including certain digital assets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To help the public spot reportable conduct, the CFTC\u2019s Whistleblower Office publishes&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\">Whistleblower Alerts<\/a>&nbsp;on priority areas, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\">Spoofing<\/a>&nbsp;and other disruptive trading in the commodities and derivatives markets<\/li>\n\n\n\n<li><a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\/FCP_WBO_Alert.htm\">Foreign corrupt practices<\/a>&nbsp;connected to the markets the CFTC oversees<\/li>\n\n\n\n<li><a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\">Bank Secrecy Act<\/a>&nbsp;failures, including deficient anti-money-laundering (AML) and suspicious-activity-report programs<\/li>\n\n\n\n<li><a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\">Insider trading<\/a>&nbsp;or other improper use of confidential information<\/li>\n\n\n\n<li><a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\">Digital asset and virtual currency fraud<\/a>, including \u201cpump-and-dump\u201d schemes and unregistered platforms<\/li>\n\n\n\n<li>Romance investment (\u201cpig butchering\u201d) frauds that steer victims into fake crypto or forex platforms<\/li>\n\n\n\n<li>Fraud and manipulation in the carbon markets<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Many of these are inherently cross-border. Benchmark manipulation is a clear example: the CFTC has brought major actions against global banks for attempting to rig foreign-exchange and interest-rate benchmarks, including a&nbsp;<a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/7056-14\">2014 order against five banks totaling more than $1.4 billion<\/a>&nbsp;and an&nbsp;<a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/7159-15\">$800 million order against Deutsche Bank<\/a>&nbsp;for manipulation and false reporting of LIBOR and Euribor.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Avoiding Eligibility \u201cTraps\u201d<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A few situations can undermine an otherwise strong claim:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Information protected by the attorney-client privilege generally does not count as original information, so set it aside when assessing your own eligibility.<\/li>\n\n\n\n<li>Certain people are excluded \u2014 for example, some government and self-regulatory personnel, employees of foreign regulatory authorities, and anyone convicted of a crime connected to the conduct at issue. Officers, directors, and partners who learned of the misconduct through the company\u2019s internal compliance processes may also be excluded, though exceptions exist, which can be better explained by experienced counsel.<\/li>\n\n\n\n<li>If you reported internally at your company first, the clock is running: reach the CFTC within 180 days and the agency will treat your \u201cplace in line\u201d as the date you reported internally.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Remember: internal reporting is optional \u2014 you can come straight to the CFTC at any time. For many international whistleblowers, particularly in countries where internal reports leak, that is the safer path.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Foreign Corruption and the FCPA: A Major Avenue for International Whistleblowers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For whistleblowers outside the United States, one of the most valuable and least understood avenues is foreign corruption that touches the commodities and derivatives markets. The CFTC has made clear it will pursue this conduct, issuing a dedicated&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/whistleblower-alerts\/FCP_WBO_Alert.htm\">Whistleblower Alert on foreign corrupt practices<\/a>&nbsp;and an&nbsp;<a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/7884-19\">Enforcement Advisory<\/a>&nbsp;signaling its expanded focus on the issue.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">How the CFTC Treats Foreign Corruption<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC does not enforce the Foreign Corrupt Practices Act (FCPA) the way the SEC does. Instead, it pursues corruption as a&nbsp;<strong>violation of the Commodity Exchange Act<\/strong>&nbsp;when that corruption affects the markets it regulates. According to the CFTC\u2019s own alert, reportable misconduct may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Corrupt practices that alter prices in commodity markets that, in turn, drive U.S. derivatives prices;<\/li>\n\n\n\n<li>Bribes used to secure business in connection with regulated activities \u2014 like trading, advising, or dealing in swaps or derivatives \u2014 paid out of funds that investors believed were being used to invest; and<\/li>\n\n\n\n<li>Corrupt practices used to manipulate benchmarks that serve as the basis for derivatives contracts, where prices that are the product of corruption are then falsely reported to those benchmarks.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is a different legal theory than the SEC\u2019s books-and-records and accounting-controls approach to the FCPA, and it can reach conduct the SEC\u2019s framework might not. This is the central nuance of the program: you may submit a tip anonymously with or without a lawyer, but to claim an award anonymously, counsel is mandatory, and your identity must be verified to the CFTC\u2019s satisfaction before any award is paid. How you gather that information matters just as much as what it shows.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whistleblowers can be disqualified \u2014 and turned down for representation \u2014 if they obtained information by hacking or by accessing materials they had no right to access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Below is an overview of what helps and what hurts.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Strengthens Your Submission<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Documents showing the mechanics of the scheme<\/li>\n\n\n\n<li>Names and roles of the people involved<\/li>\n\n\n\n<li>Dates and amounts of specific transactions<\/li>\n\n\n\n<li>The location of additional records<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Remember from Step 2 that helping staff understand complex transactions and pointing them to key witnesses and documents can potentially raise your award percentage.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Can Hurt You<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Privileged materials:&nbsp;<\/strong>information subject to the attorney-client privilege is generally excluded from the definition of original information.<\/li>\n\n\n\n<li><strong>Unlawful collection:&nbsp;<\/strong>accessing systems or records you have no right to access can expose you to criminal liability in your home country.<\/li>\n\n\n\n<li><strong>Local data and secrecy laws:&nbsp;<\/strong>many countries restrict moving personal data or business records across borders \u2014 from the EU\u2019s GDPR to bank-secrecy and blocking statutes elsewhere.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Protect Your Identity<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Below are practices developed over decades of representing and protecting whistleblowers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Use a personal device:&nbsp;<\/strong>do your research on a non-work device and network. Never use your work email, phone, or company device to contact attorneys or the CFTC.<\/li>\n\n\n\n<li><strong>Avoid cloud and email:&nbsp;<\/strong>if the information is on company systems, don\u2019t forward it to email or the cloud. Where lawful, use a personal storage device to keep your own copies.<\/li>\n\n\n\n<li><strong>Remain silent:&nbsp;<\/strong>don\u2019t tell anyone what you\u2019ve found or that you plan to report it. Silence and patience are the most important qualities of successful whistleblowing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Make copies of everything and store them somewhere safe and secure. If you have documents in other languages, have them translated independently or with your legal counsel.&nbsp;<strong>Avoid translating sensitive documents using AI tools.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Step 5: Submitting Your Tip to the CFTC<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">With your evidence in hand, you\u2019re ready to submit an official tip using the CFTC\u2019s&nbsp;<a href=\"https:\/\/forms.cftc.gov\/_layouts\/PublicForms\/Whistleblower.aspx\">Form TCR (Tip, Complaint, or Referral)<\/a>. The Whistleblower Office strongly encourages filing through its&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/overview\/submitatip\">online portal<\/a>; a Form TCR can also be submitted by mail or fax, but only one method is needed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After you file, the Whistleblower Office will confirm in writing that your Form TCR was received and give you a confirmation number \u2014 keep it. If you don\u2019t receive written confirmation within 14 days, the office asks that you email it directly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remember the central rule: anyone can submit a tip anonymously, but claiming an award anonymously requires an attorney who files on your behalf.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Happens Next<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC reviews every tip. Your information could prompt the Commission to open a new investigation, reopen a closed one, pursue a new line of inquiry in an ongoing matter, or significantly contribute to an enforcement action already underway.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Don\u2019t expect to hear much after you file.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC conducts investigations confidentially and generally will not tell you whether it has opened an investigation or where one stands. The agency acknowledges this can be frustrating, but the silence protects the investigation and everyone involved \u2014 including you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No news does not mean your tip went nowhere.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In FY2025, roughly a third of the CFTC\u2019s enforcement leads originated from whistleblower tips.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you later obtain additional information, you can supplement your tip by email \u2014 just reference your original confirmation number. Ongoing cooperation is often how the strongest cases are built, and (per Step 2) it can push award percentages upward.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Step 6: Monitor for a Covered Action and Apply for Your Award<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s important to understand from the start that the CFTC does not automatically pay you when a case succeeds. You have to apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the CFTC obtains a judgment or settlement imposing more than $1 million in monetary sanctions, the Whistleblower Office posts a&nbsp;<a href=\"https:\/\/www.whistleblower.gov\/notices\">Notice of Covered Action (NCA)<\/a>&nbsp;on its website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC does not contact whistleblowers individually about these postings, so you\u2019ll need to monitor the page \u2014 or&nbsp;<a href=\"https:\/\/public.govdelivery.com\/accounts\/USCFTCWB\/subscriber\/new\">subscribe to email alerts<\/a>&nbsp;that fire when a new NCA is posted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, this monitoring is one of the most concrete things U.S. counsel does for a whistleblower nine time zones from Washington.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The 90-Day Deadline Is Unforgiving<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Once the relevant NCA is posted, you must submit&nbsp;<a href=\"https:\/\/forms.cftc.gov\/_layouts\/PublicForms\/WBAppForm.aspx\">Form WB-APP<\/a>&nbsp;within 90 calendar days. There is no second chance to claim the award. For Related Actions, you apply within 90 days of the judgment or order in that action; the CFTC does not post notices for Related Actions, so you must monitor other authorities\u2019 cases on your own.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The application is more than a formality \u2014 it\u2019s where you make your case. Address any factual issues directly: if an exclusion might apply to you, explain why it doesn\u2019t; if you delayed reporting, explain the circumstances; if you had any role in the misconduct, address it fully.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Happens After You Apply<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Since the rules were amended in 2017, the CFTC\u2019s award-review process closely mirrors the SEC\u2019s. The Claims Review Staff issues a Preliminary Determination recommending that your claim be granted or denied \u2014 and, if granted, at what percentage. You have an opportunity to view the record and contest a preliminary denial before the Commission issues a Final Determination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If sanctions are collected only in part, you still receive your determined percentage of what is actually collected, and you remain eligible for the same percentage of any amounts the CFTC collects later. Awards are paid from the Customer Protection Fund and do not reduce the money owed to harmed customers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Long Does the Process Take?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The CFTC publishes no official timeline, but in practice the path runs through three stages, each with its own clock:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Investigation (often several years):&nbsp;<\/strong>after your tip is filed, the CFTC investigates confidentially and won\u2019t comment on its status.
